4. Photographs & Image Use

All images captured during your session remain the intellectual property of Creatively Curious Photography unless otherwise agreed in writing.

Promotional use: Unless you have selected the opt-out option in your signed client agreement, CCP reserves the right to use final edited images for promotional purposes including but not limited to Instagram, TikTok, our website, portfolio, and marketing materials.

Opt-out: Clients who wish to opt out of promotional image use may do so by selecting the opt-out option in their client contract. An additional opt-out fee applies as outlined in your agreement.

Minors: If your session includes individuals under the age of 18, a parent or legal guardian must provide written consent before images may be used for any promotional purpose. CCP will not publish or share images of minors without explicit parental or guardian consent.

5. How We Share Your Information

We do not sell your personal data. We may share your information only in the following circumstances:

Service providers: We work with trusted third-party platforms to operate our business, including but not limited to:

• Pass — digital image delivery

• Square / Venmo / PayPal — payment processing

• Wix — website hosting and form collection

• Google — email and document management

• MPix — print fulfillment (when applicable)

Each of these providers has their own privacy policy governing how they handle your data.

Legal requirements: We may disclose your information if required to do so by law, court order, or government authority, or if we believe disclosure is necessary to protect our rights or the safety of others.

Business transfers: In the unlikely event that Creatively Curious Photography is sold or transferred, your information may be transferred as part of that transaction. You will be notified of any such change.

We retain your personal information for as long as is necessary to fulfill the purposes outlined in this policy and to comply with our legal obligations. Specifically:

• Client contact and booking information is retained for a minimum of 3 years from the date of your session

• Signed contracts are retained for a minimum of 5 years

• Photographs and image files are retained for up to 2 years from the date of your session, after which they may be permanently deleted

• Digital gallery links via Pass expire per that platform's retention policy — clients are responsible for downloading images promptly
