Creatively Curious Photography

Introduction

  • These Terms & Conditions govern all photography and editing services provided by Creatively Curious Photography, owned and operated by Sami Roby under Creatively Curious Colorado, LLC, based in Denver, Colorado. By booking a session, signing a client agreement, or engaging our services in any capacity, you agree to the terms outlined on this page in full.

  • Please read these terms carefully before booking. If you have any questions, contact us directly before your session date.
     

1. Scope of Services

  • Creatively Curious Photography agrees to provide photography and/or editing services as outlined in your individual session agreement. The scope of services is limited to what is specified in that agreement. Any additional requests made on the day of the session may be subject to additional fees at the photographer's discretion.
     

2. Payment

  • Accepted payment methods: Zelle · Venmo · Klarna · Affirm · AfterPay

  • Booking fee: A non-refundable booking fee of 33% of the total session cost is required to secure and retain your preferred session date. Your date is not held until this fee is received. Prior to payment of the booking fee, your preferred date may be booked by another client.

  • Remaining balance: The remaining balance is due on or before the day of the session. Failure to submit full payment by the agreed date may result in session cancellation without refund of the deposit.

  • Image release: Final edited images will not be released until full payment has been received. Prior to full payment, images may only be shared from Creatively Curious Photography's official social media accounts with a watermark applied.
     

3. Payment Arrangements

  • Creatively Curious Photography offers payment arrangements as a courtesy to make high-quality photography accessible to all clients. Payment plans are available on a case-by-case basis and are not guaranteed.

  • To set up a payment arrangement:

  • If using Klarna, Affirm, or AfterPay — select your preferred option at checkout

  • For all other arrangements — contact Sami directly before booking

  • Payment plan terms:

  • All pre-payments made under a payment arrangement are non-refundable

  • Transfers of pre-payments to another session or date are at the photographer's sole discretion

  • The 33% booking fee must be paid to retain your preferred session date regardless of payment plan status

  • Failure to adhere to an agreed payment schedule may result in loss of access to payment arrangements for future bookings

  • Creatively Curious Photography does its best to work with clients and will always aim to find a solution. This courtesy is offered in good faith and depends on both parties honoring the agreed terms.
     

4. Hourly Rate, Overtime & Discounts

  • Services are billed at the agreed hourly rate specified in your session agreement. Sessions extending beyond the scheduled end time will be billed in 15-minute increments at the same hourly rate. Clients will be notified before overtime charges begin when possible.

  • Any discounts applied to a session are solely at the photographer's discretion and may not always be available. Word-of-mouth referral credits must be redeemed within one calendar year of issuance and may be subject to different pricing structures at the time of redemption.
     

5. Additional Images & Add-Ons

  • Additional images beyond your package are often available at bulk pricing or à la carte per image. Clients may purchase additional images at the quoted rate within one fiscal quarter of the session date. After that window, pricing may be subject to change.

  • Available add-ons:

  • Additional editing, retouching, color correction, or filter modifications (e.g. black & white) — priced per image or per session

  • Multiple outfit changes — available on select sessions and may impact final image count

  • Additional subjects (people or animals) — may result in increased cost depending on the package

  • Minor retouching (object removal, blemish removal, slight adjustments) — available per package or charged at the advanced Photoshop rate

  • Advanced Photoshop and photo manipulation — charged at $50/hour starting rate. Extensive manipulation is contracted to a third party and billed at third-party rates. Creatively Curious Photography does not replace items, move hands, or perform advanced compositing in-house.
     

6. Cancellation & Rescheduling

  • Booking fees, retainer deposits, and all payments made are non-refundable. Cancellations prior to the session result in forfeiture of all deposits paid.

  • Cancellations due to weather or documented emergency circumstances will be rescheduled at no penalty at the photographer's discretion.

  • Rescheduling is subject to photographer availability and is not guaranteed during peak seasons including fall colors season. A second reschedule request may require an additional deposit of 50% of the total session cost.
     

7. Turnaround & Delivery

  • Step 1 — Image selection:
    Within 48 business hours of your session, Sami will upload your images and send you a gallery link. Clients have 3–5 business days to select their included images. If no selection is made within that window, the photographer will make the selection. One-hour sessions typically yield 200 or more images to choose from.

  • Step 2 — Editing & delivery:
    Once your selections are received, please allow 1–3 weeks for full retouching and delivery. Final edited images are delivered via Adobe Lightroom as a separate JPEG download album.

  • Rush delivery is available for an additional fee, determined at the time of request based on the scope of the session and the number of images selected.

  • Raw, unedited files are not included in any package and are not available for purchase unless otherwise agreed upon in writing prior to the session.
     

8. Bulk Pricing & Additional Image Purchase

  • Clients who wish to purchase the full album or additional images beyond their package may do so at bulk pricing. Bulk pricing is determined at the time of delivery based on total image yield.

  • Payment plans are available for bulk image purchases if requested immediately at the time of selection. Pricing on additional images is subject to change outside of the one-quarter purchase window.
     

9. Image Rights & Ownership

  • Creatively Curious Photography retains full copyright of all images produced under any client agreement. Upon receipt of full payment, the client is granted a non-exclusive license to use final edited images for personal and/or commercial purposes, including printing and sharing on personal and business social media accounts.
     

10. Social Media & Promotional Use

  • By booking a session with Creatively Curious Photography, the client grants Creatively Curious Colorado, LLC full permission to use, reproduce, and share final edited images across social media platforms, websites, portfolios, marketing materials, and client testimonials. This includes but is not limited to Instagram, TikTok, Facebook, and any future platforms. No additional compensation is owed to the client for this use. Clients may be tagged with their consent.
     

11. Social Media Opt-Out

  • Clients who wish to opt out of promotional and social media use of their images must notify the photographer prior to the session date. Opt-out requests made after the session may not be honored.

  • Social media opt-out may result in an additional fee of 10–30% of the total session cost, not to exceed $300, at the photographer's discretion. Creatively Curious Colorado, LLC will always aim to work with clients on this where possible.

  • Opting out of promotional use does not affect the client's personal use license to their final images.
     

12. Model Release

  • By booking a session, the client and all individuals photographed consent to the use of their likeness as described in Section 10 of these terms. If the session includes minors under the age of 18, a parent or legal guardian must sign the client agreement on their behalf. Creatively Curious Photography will not publish or share images of minors without explicit parental or guardian consent.
     

13. Liability

  • Creatively Curious Photography is not responsible for failure to deliver images due to equipment failure, illness, or circumstances beyond reasonable control. In such cases, a full or partial refund or transfer of services may be issued at the photographer's discretion. The photographer's total liability shall not exceed the total amount paid by the client under the applicable agreement.

  • Satisfaction disclaimer: Dissatisfaction with images that is not related to the quality of the photographer's work does not qualify as a failure to execute services. This includes but is not limited to lack of child cooperation during the session, use of an unsupported print service, or personal body image or perception. Creatively Curious Photography delivers professionally edited images that meet our quality standards — satisfaction with the subject matter is outside our scope of control.

  • Print quality note: Creatively Curious Colorado, LLC strongly discourages printing through Snapfish or Walmart due to inconsistent color and quality results. We recommend MPix for all print orders and have a discount code available upon request.
     

14. Governing Law

  • These Terms & Conditions and all client agreements are governed by the laws of the State of Colorado. Any disputes arising under these terms shall be resolved in Denver County, Colorado.
     

15. Updates to These Terms

  • Creatively Curious Photography reserves the right to update these Terms & Conditions at any time. Updates will be reflected by a revised date at the top of this page. Terms in effect at the time of your booking apply to your session regardless of subsequent updates.
